Attorneys Timothy R. Scannell and Walter J. Klimczak, III recently obtained a Summary Judgment ruling that its client did not owe the plaintiff a duty of care.
Attorneys Scannell and Klimczak represented a company who had previously performed work on a door at the premises. The plaintiff claimed that he was injured by the door and sued multiple parties, including defendant represented by Attorneys Scannell and Klimczak. After establishing the scope of work performed by the client in discovery, Attorneys Scannell and Klimczak moved for Summary Judgment. In granting the Summary Judgment motion, the Court agreed that the defendant had no knowledge or notice of the alleged dangerous condition, and that it did not owe the plaintiff a duty of care.
