Shareholder Nicholas B. Kosiavelon won a defense verdict in a product liability case alleging serious personal injury.
The Plaintiff brought a contribution action against a product seller based upon negligence/product liability theories. The Plaintiff alleged that a brush cutter sold and serviced by the Defendant came apart in use and a large saw blade nearly severed the operators calf muscle causing permanent injury.
The Defense focused on post-sale modifications to the brush cutter and improper maintenance as the proximate causes of the injury. The jury returned a unanimous verdict in favor of the Defendant.
