Commercial Dispute—Defense Verdict

Attorney Jonathan Killeen received a defense verdict following a bench trial. Attorney Killeen successfully represented a regional last mile delivery company providing services to the Eastern and Midwest United States. The multi-party case involved allegations for negligence, breach of contract, and fraudulent misrepresentation arising out of the defendants’ alleged failure to deliver consumer products to the plaintiffs and then reporting the products delivered. Following testimony from both plaintiffs and three defense witnesses, the court returned a defense verdict concluding that the plaintiffs failed to meet their burden of proof and that the defendants did, in fact, deliver the disputed products to the plaintiffs.
