Premises Liability – Fall – Summary Judgment

Attorneys Thomas H. Houlihan, Jr. and Walter J. Klimczak, III recently obtained a Summary Judgment ruling in favor of its client that it was owed defense and contractual indemnification under the terms of a Lease Agreement.
The plaintiff sued the defendants claiming injuries as the result of a fall on the property. Attorneys Houlihan and Klimczak represented the Lessee of the property and, after a tender was denied, they asserted cross-claims against the Lessor of the property for defense and indemnification. Thereafter, Attorneys Houlihan and Klimczak moved for Summary Judgment. In granting the motion, the Court held that the evidence was unambiguous that the Lessor owed the Lessee defense and indemnification, and granted the motion in its entirety.
